The Karnataka High Court said that match fixing does not amount to the offence of cheating and therefore the offence under Section 420 IPC can not be invoked against the alleged offenders.
Many instances of match-fixing unearthed by the Bengaluru Police Crime Branch in 2019. Chargesheet against three Cricket players and a team official of Karnataka Premier League (KPL) has been quashed by the Karnataka High Court after conducting an investigation of alleged corruption.
A single judge bench of Justice Sreenivas Harish Kumar ordered the quanshing of the chargesheet filed against former cricket captain C M Gautam, Abrar Kazi and Amit Mavi and the owner of the Belagavi Panthers team, Asfak Ali Thara.
“It is true that if a player indulges in match fixing, a general feeling will arie that he has cheated the lovers of the game. But, this general feeling does not give rise to an offence”, said Justice Sreenivas Harish Kumar.
