A day after Delhi High Court granted bail to Devangana Kalita, Natasha Narwal and Asif Iqbal Tanha, the Delhi Police on Wednesday moved to Supreme Court challenging the High Court’s bail order.
Delhi Police challenged the city high court’s bail order in a Special Leave Petition filed before Supreme Court.
Delhi High Court on Tuesday granted bail to Pinjra Tod activist Devangana Kalita and Natasha Narwal. The court also granted bail to Asif Iqbal Tanha, a Jamia Millia Islamia student pursuing his final year in B.A. (Hons. in Persian). He was arrested under the Unlawful Activities (Prevention) Act (UAPA) in connection with the Delhi riots.
Delhi Police in a official statement informed –
“We are not satisfied with the interpretation of the provisions of Unlawful Activities Prevention Act by the Hon’ble High Court in a matter concerned with grant of bail. We are proceeding with the filing of a Special Leave Petition before the Hon’ble Supreme Court of India.”
All the three – Devangana Kalita, Natasha Narwal and Asif Iqbal Tanha were arrested in May last year in connection with cases related to the clashes that broke out in northeast Delhi in February, 2020.
Narwal and Kalita were arrested for allegedly being a part of a premeditated conspiracy behind the violence that broke out in Delhi during protests against the Citizenship (Amendment) Act (CAA).
While granting bail to all the three, the Delhi HC on Tuesday state –
“We are constrained to express that it seems that in its anxiety to suppress dissent, in the mind of the State, the line between the constitutionally guaranteed right to protest and terrorist activity seems to be getting somewhat blurred. If this mindset gains traction, it would be a sad day for democracy.”

Now, the Delhi Police has moved the Supreme Court to challenge the bail granted to Devangana Kalita, Natasha Narwal and Asif Iqbal Tanha in the riot case.
Lawyers, appearing on behalf of Asif Tanha, Natasha Narwal and Devangana Kalita, have requested the court to send their release warrant via email to Tihar jail.
Asif is currently on custodial bail to take his BA final exams, while the other two are in jail.
Lawyers have requested the court to expedite the verification and paperwork so that they can be released by Wednesday evening.
