A woman from Gujarat has sent 150 condoms to Bombay High Court additional judge Justice Pushpa V Ganediwala. Recently the High Court judge became famous for her controversial remarks on the sexual assault cases under the POSCO Act.
The woman, Devshri Shastri, is a self-proclaimed political analyst from Gujarat, Ahmedabad.
She has sent condoms to 12 different locations, including Justice Ganediwala’s chamber, the Registry of the Nagpur bench of the Bombay High Court, and the Principal bench in Mumbai.
“I cannot tolerate injustice. A minor girl did not get justice because of a judgment by Justice Ganediwala. I am demanding that she (Justice Ganediwala) be suspended,” Trivedi stated.
“As a woman, I do not feel I have done anything wrong. I have no guilt. Women have to stand up for their rights. By this order of Justice Ganediwala, men can go without any judgment for sexually assaulting girls over their clothes,” she said.
Earlier, Ganediwala had made remarks in a case involving a 12-year-old girl. She was groped by a 39-year-old man in December 2016.
Ganediwala ruled out sexual assault punishable with POCSO and had constituted the offense under outraging a woman’s modesty under IPC section 354. The reason for ruling out of judgment was- “she had her top on and there was no ‘skin to skin contact’, hence the groping could not be ruled as an assault.”
Recently, Devshri Trivedi uploaded videos on her YouTube page showing packets of condoms ready to be mailed to various addresses in Nagpur including the High Court registry and judge Ganediwala’s residence.
The Supreme Court, however, has put the Bombay High Court order on hold.
